Crimes of Violence and Mandatory Sentences

There are certain offenses in Colorado that the state designates as “crimes of violence.” These differ from standard violent crimes in a few ways.

First, they involve a deadly weapon. Regardless of whether the defendant used the weapon, threatened to use it, or possessed it at the time of the crime, the presence of it constitutes a crime of violence. Second, the offense will have injured a victim or caused them to die. Courts can charge offenses such as murder, robbery, assault, kidnapping, sexual assault, and others as crimes of violence if these things have happened.

If a person is convicted of a crime of violence, they will face a mandatory minimum sentence, which a judge typically cannot decrease. Depending on the offense, sentencing ranges from 1.5 to 4 years for lower-level felony crimes to 16 to 48 years for the most severe offenses. For certain sexual offenses such as sexual assault or patronizing a prostituted minor, a crime of violence conviction could result in a life sentence.
